The terms of the sale.

These conditions govern every distance contract concluded through mcaabbigliamento.shop between the operating company — the seller — and a consumer. They are the terms you accept at checkout, and they are the terms that apply to the order.

A consumer is a natural person acting for purposes outside their trade or profession. The statutory protections described below — withdrawal, the legal guarantee, jurisdiction — apply to consumers. Business buyers may order, but those specific consumer protections do not apply to them.

Woven shirts for adults. Each product page states, before you can add anything to a cart:

• fibre composition, in Italian, by descending weight, as EU Regulation 1007/2011 requires;
• cloth weight in grams per square metre, and the weave;
• the country where the cloth was woven and the country where the garment was made;
• a full table of measurements in centimetres for every size, taken flat;
• the height of the model in the photographs and the size worn;
• our airflow and creasing ratings, with a statement of what they are;
• washing, drying and ironing instructions.

Colour on a screen is not colour in daylight. Natural fibres also vary between production runs, and shell buttons vary in tone and figure by nature. Neither is a defect.

Our airflow and creasing ratings are our own relative positions across this catalogue, not laboratory measurements. We publish no easy-care, antibacterial, ultraviolet-protective, therapeutic, slimming or environmental claim about any product.

All prices are shown in US Dollar (USD) and nothing else; there is no currency selector, and the amount you see is the amount charged. Prices in this catalogue run from $54 to $398.

Prices are inclusive of tax (IVA inclusa; the Italian standard rate is 22%). No charge is added at any later step that was not shown before it. Shipping, where it applies, is shown in the cart and again in the checkout summary before the order is placed.

Costs that may fall outside the price

• Standard shipping is $14, and free on orders of $129 or more. Express is $29.
• Deliveries outside the European Union may attract import duty and local tax, charged by the destination country on arrival. These are not collected by us, are not included in the price, and are payable by the recipient.

Reference prices and discounts

Where a previous price is shown struck through, it is the lowest price we applied to that product in the thirty days before the reduction, as Legislative Decree 26/2023 requires. Where we cannot satisfy that test, no struck-through price is displayed at all. We do not run countdown timers or artificial scarcity notices.

Promotional codes

A first-order code may be offered. It applies once per customer, to the value of the goods only and not to shipping, cannot be combined with another code, and does not extend to orders already placed. The percentage in force is the one shown where the code is offered.

1. You add items to the cart and open the checkout.
2. You complete your details. The order cannot proceed while a required field is incomplete.
3. You confirm you have read these conditions and the right of withdrawal, and you agree to your details being used to fulfil the order. Marketing consent is a separate, optional tick and is never a condition of purchase.
4. You are taken to the secure payment page, where the total shown in the summary is taken.
5. We send an order confirmation by email. The contract is concluded when that confirmation is sent.

We may decline an order where the item is no longer available, where the address cannot be served by our carriers, or where we have reasonable grounds to suspect fraud. If payment has already been taken in such a case, it is refunded in full.

Payment is taken on a secure, encrypted payment page operated by a PCI-DSS compliant payment services provider. Card numbers are entered on that page, are never seen by this website, and are never stored on our servers or in our database.

The whole site is served over HTTPS. The amount authorised is the total shown in the checkout summary, in US Dollar (USD), with nothing added afterwards.

If a payment is declined the order is not concluded and nothing is dispatched. You are free to try again or to write to us and we will complete it by hand.

Orders are dispatched within 1–2 business days of the order being confirmed. Estimated transit is 5–9 business days for standard, 2–4 for express.

Where no delivery date has been separately agreed, we deliver within 30 days of the conclusion of the contract at the outside. If we cannot, you may set an additional period appropriate to the circumstances; if that passes without delivery you are entitled to terminate the contract and be refunded in full, without delay.

Risk of loss or damage passes to you when you, or a carrier you chose yourself rather than one we proposed, take physical possession of the goods.

You have 14 days to withdraw from this contract without giving any reason. The period runs from the day on which you, or a third party you name other than the carrier, take physical possession of the goods; where an order is delivered in several parcels, from the day the last one arrives.

To withdraw, tell us so in an unambiguous statement — email is enough. You may use the statutory model withdrawal form, which we publish and provide as a download, but you are not obliged to.

If we had failed to inform you of this right, the withdrawal period would extend to twelve months from the end of the initial fourteen days.

Exclusions

Nothing in this catalogue is made to your specification or personalised, and nothing is sealed for reasons of hygiene. No product sold here is excluded from the right of withdrawal. Should that ever change, the exclusion would be stated on the individual product page and not only here.

Everything else — the refund period, the return costs, your liability for handling beyond what is needed to establish the nature and characteristics of the goods — is set out on the right of withdrawal page, together with the form.

Everything sold here carries the two-year legal guarantee of conformity under the Consumer Code. It is owed by us, the seller, not by a manufacturer, and you claim it from us.

Where a lack of conformity appears within 12 months of delivery, it is presumed to have existed at delivery unless we prove otherwise. After that, the burden shifts to you.

The remedies run in order: repair or replacement first, at your choice, unless the one you choose is impossible or disproportionate; then a proportionate price reduction or termination of the contract.

Any commercial guarantee we might offer sits in addition to this legal guarantee. It cannot replace it, reduce it or shorten it, and no term of ours purports to.

We ship worldwide to the countries listed at checkout. Where a country is not listed, we cannot currently serve it.

• Orders cannot be placed by anyone under 13. Between 13 and 17, a parent or guardian’s email address is required and their agreement is sought before dispatch.
• The goods are ordinary adult clothing and are not subject to export control. We do not sell to any territory subject to relevant international sanctions.
• Import duty and local tax outside the European Union are the recipient’s responsibility, as set out above.
• We do not resell, and orders that appear to be for resale may be declined; the consumer protections here are for consumers.

We are liable for the conformity of what we sell and for the performance of this contract, on the terms the Consumer Code sets out. Nothing here excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot lawfully be excluded — and nothing here reduces any right you have as a consumer.

Subject to that:

• we are not liable for delay or non-performance caused by events outside our reasonable control — carrier disruption, industrial action, natural events, or the closure of a border — although you keep the right to terminate and be refunded if delivery becomes impossible or the agreed period passes;
• we are not liable for import duty or local tax charged by a destination country outside the European Union, which is set by that country and disclosed above;
• we are not liable for damage caused by care contrary to the instructions on the garment and on its product page.

The site is provided for the purpose of buying these goods. Product photography is taken honestly, including of creasing, but colour reproduction varies by screen and is not a representation.

Governing law and the court

These conditions are governed by Italian law. Where the buyer is a consumer, the court of the consumer’s place of residence or domicile has exclusive jurisdiction, and nothing in these terms displaces that. Mandatory protections under the law of the consumer’s country of residence are unaffected.

If any provision here is held invalid, the rest stands. Failing to enforce a term is not a waiver of it.

We may revise these conditions. The version that governs your order is the one published when the order was placed, and the revision date is at the top of this page. A revision never affects an order already concluded.
